Privacy Policy

I.Basic Provisions

1. The controller of personal data according to Art. Point 4 of Article 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "GDPR") is Avitex, s.r.o., ID No. 60745291, with its registered office at Rybná 716/24, 11000 Prague 1 (hereinafter referred to as "controller").

3.Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

4. The administrator has not appointed a data protection officer.

 

II.

Sources and Categories of Processed Personal Data

  1. The administrator processes personal data that you have provided or personal data that the administrator has obtained based on fulfilling your order:

  • first name and last name

  • email address

  • mailing address

  • phone

  1. The administrator processes your identification and contact details and data necessary for the fulfillment of the contract.

 

III.

Legal Basis and Purpose of Personal Data Processing

  1. The legal basis for processing personal data is

  • fulfillment of the legal obligation of the controller according to Art. 6 paragraphs. 1 letter. c) GDPR,

  • the legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) according to Art. 6 paragraphs. 1 letter. f) GDPR,

  • Your consent to processing for the purposes of direct marketing (especially for sending commercial communications and newsletters) according to Art. 6 paragraphs. 1 letter. a) GDPR in connection with § 7 para. Section 2 of Act No. 480/2004 Coll., on Certain Information Society Services, in the event that no goods or services have been ordered.

  1. The purpose of processing personal data is

  • processing your order and exercising rights and obligations arising from the contractual relationship between you and the administrator; personal data required for successful order processing (name and address, contact) are requested when placing an order, providing personal data is a necessary requirement for concluding and fulfilling the contract, without providing personal data it is not possible to conclude the contract or for the administrator to fulfill it,

  • fulfilling legal obligations towards the state,

  • sending commercial communications and conducting other marketing activities.

  1. There is no automated individual decision-making by the controller in the sense of Art. 22 GDPR.       

 

IV.

Data retention period

  1. The administrator stores personal data

  • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).

  • for the period until the consent to the processing of personal data for marketing purposes is withdrawn, for a maximum of 15 years, if the personal data are processed based on consent.

  1. After the expiration of the personal data retention period, the controller will delete the personal data.

 

V.

Recipients of personal data (controller's subcontractors)

  1. Recipients of personal data are individuals

  • involved in the delivery of goods/services/payment execution based on a contract,

  • providing e-shop operation services (Binargon) and other services related to the operation of the e-shop,

  • providing marketing services.

  1. The administrator does not intend to transfer personal data to a third country (a country outside the EU) or an international organization.

Data Processors

  1. The processing of personal data is carried out by the controller, but these processors may also process personal data for him:

  • service provider Ecomail.

Your rights

  1. Under the conditions set out in the GDPR, you have

  • the right to access your personal data according to Art. 15 GDPR,

  • the right to rectification of personal data according to Art. 16 GDPR, or possibly restriction of processing according to Art. 18 GDPR,

  • the right to erasure of personal data according to Art. 17 GDPR,

  • the right to object to processing pursuant to Art. 21 GDPR,

  • the right to data portability according to Art. 20 GDPR and

  • the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Art. III of these terms.

  1. You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated, or to take the matter to court.

 

VII.

Personal Data Security Conditions

  1. The administrator declares that they have taken all appropriate technical and organizational measures to secure personal data.

  2. The administrator has implemented technical measures to secure data storage and personal data storage in paper form, particularly by password protection and securing the storage facilities

  3. The administrator declares that personal data is only accessible to persons authorized by him.

 

VIII.

Final Provisions

  1. By submitting an order from the online order form, you confirm that you are familiar with the terms of personal data protection and that you fully accept them.

  3. The administrator is authorized to change these terms. The new version of the privacy policy will be published on their website.

 

These terms become effective on the 3rd.6.2022
